1. Definition “Catamaran” refers to the vessel as described in the attached invoice. “Port of embarkation/disembarkation” refers to the Palm Cay Marina. 2. Payment Terms for the Catamaran Charter Fees The price for the catamaran charter, applicable taxes, insurance, and any other amounts due under this charter agreement are specified and detailed in the attached invoice. A provisioning advance (hereinafter referred to as the “Advance”) amounting to 50% of the total charter price is also specified in the attached invoice. Any expenses incurred by the Charterer or other passengers during the charter exceeding the Advance will be invoiced after the charter. If the expenses incurred by the Charterer and other passengers at the end of the charter do not reach the total Advance amount, the difference between the Advance and the actual expenses will be refunded to the Charterer. A gratuity of ten to fifteen percent (15% - 20%) is expected for the crew. The gratuity must be given to the captain in cash before disembarkation from the catamaran. All amounts invoiced in the charter agreement or at the end of the charter agreement must be paid in US dollars (USD) by check, bank transfer, or cash. 3. Cancellation The Owner reserves the right to cancel the charter agreement if all or part of the charter fees are not paid on time as specified in the attached invoice. In the event of cancellation, all amounts paid by the Charterer to the Owner will be retained by the Owner as liquidated damages. 4. Obligations of the Owner and the Charterer The Owner agrees to provide the Charterer with the Catamaran, including all amenities and services presented in this contract and specified in the attached invoice. The Charterer agrees to charter the Catamaran and pay for the fees and services listed in this contract. The Owner will provide the following crew members: a Captain and a Chef. 5. Use of the Catamaran for Pleasure Purposes Only The Charterer will be permitted to board the Catamaran
